According to an internal memo reported by The Guardian, Rubio stated, "sex, and not gender, shall be used" in official documents, including passports and birth reports abroad.
The executive order, titled “Defending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government,” also suspends any application requesting changes to gender markers. While passports with 'X' markers remain valid, renewing them could become problematic for current holders. The State Department began issuing 'X' gender markers in April 2022, but it remains unclear how many passports currently bear this classification.
